Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Moment Acclaim (“Moment Acclaim”, “we”, “us”) about your use of the Moment Acclaim website and services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information.

You must be at least 16 years old, and old enough to form a binding contract where you live, to create an account. You sign in with your Google account. You are responsible for activity under your account and for keeping your Google account secure.

You can create a moment and receive a private link to share it. A moment opens to anyone with the link on its occasion date and stays viewable for 3 days. Anyone with the link can view it, so you are responsible for who you share it with. Each account has a limited number of moments, which you can increase through the referral program. We may change these limits and features.

You keep ownership of the text, photos, and other material you add to moments (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, and display Your Content only to operate and provide the Service to you and the people you share links with. This license ends when Your Content is deleted from the Service, except for copies in backups that are overwritten over time.

You confirm that, for Your Content:

• you own it or have permission to use it, including photos of other people;
• you have the right to share any personal information it contains about others, and the people featured would reasonably expect it to be shared this way;
• it does not violate anyone’s privacy, publicity, intellectual property, or other rights.

You agree not to use the Service to:

• harass, threaten, bully, defame, or impersonate anyone;
• share sexual content involving minors, intimate images without consent, or any illegal content;
• share other people’s sensitive information, identity documents, or financial details;
• send spam, phishing, malware, or deceptive links;
• infringe anyone’s copyright, trademark, or other rights;
• try to access other users’ data, guess moment links, overload the Service, or get around its limits or security; or
• create fake accounts or otherwise abuse the referral program.

We may remove content or disable moments that we reasonably believe break these Terms or the law, and may report illegal content to the authorities.

If you think a moment breaks these Terms, infringes your rights, or includes information about you that you want removed, email support.momentacclaim@gmail.com with the moment link and an explanation. We will review reports and act where appropriate.

The Service, including its design, templates, music, text, and software, belongs to us or our licensors. We give you a limited, personal, non-transferable right to use the Service under these Terms. Please do not copy, resell, or reverse-engineer it except where the law allows.

You can stop using the Service at any time and ask us to delete your account by emailing support.momentacclaim@gmail.com. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Service. Where reasonable, we will give you notice first.

We work hard to keep Moment Acclaim reliable, but the Service is provided “as is” and “as available”. To the extent the law allows, we do not promise that it will be uninterrupted, error-free, or that a moment will open or display exactly when expected. Please keep your own copies of photos and messages that matter to you. Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract.

To the extent the law allows, Moment Acclaim will not be liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for death or personal injury caused by negligence, or for fraud.

If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and may bring claims in your local courts.

We may update these Terms. We will post the new version here and update the “Last updated” date. If a change is material, we will notify you before it takes effect. If you keep using the Service after that, the updated Terms apply.
